I have been struggling with fibromyalgia for over two years now. I also have another autoimmune called sjogrens. There are days where I am unable to take even a few steps, and then others where I can walk around 40 yards. The fog, and the pain are unbearable. My question is, does anyone out there receive disability for fibromyalgia?

Hi Tricky522,

I'm very sorry to hear about your fibro pain and brain fog.

There are a few people on this board that are on SS disability or are in the application process. Do a word search with "disability" and or "SSDI" to see previous threads. Obtaining SS disability with Fibromyalgia and/or Chronic Fatigue Syndrome is possible, but as with all SS disability applications, be prepared for an uphill battle.

The good news is that SS does recognize fibromyalgia as a disability. Do a search on google search on "SSR 12-2p".

Take care!

Hi Tricky
I applied for disability and it was a ridiculous ongoing joke for 2 years until they final denied the claim. I could not afford a lawyer, so I did not have much hope trying to fight it on my own. I believe that you need to apply and appeal repeatedly in order to get anywhere. But it is definitely very difficult. If you have very cooperative doctors who keep very good records of your visits and your problems, that helps a lot. I saw 6 specialists, all submitted records, and still I was denied. You never know though, give it a shot. The whole process is a real pain.....like we need anymore of that, right?

Gentle Hugs
Sue

Sue, lawyers' fees may not exceed 25% of the past-due lump sum benefits awarded, and currently is capped at a maximum of $6000. Their payment is contingent on you winning the case. You owe them nothing if you lose. Social Security will deduct the fees from the lump sum benefits automatically before issuing the rest to you.

Moe, I'm not sure what they meant by you "not having enough work time for the last year" to be eligible. Was this SSA or a legal representative that told you this?

There are many people who have been out of work for many months, if not years, before they apply for SS disability.

Yes, I think it a good idea that you talk to a legal expert ASAP to see if you are qualified to apply for SS disability. Please let us know what you find out.

Thanks so much to everyone that replied. I was denied disability and I now have a lawyer. However the waiting period is 12 to 16 months. I have worked all of my life. I loved my job. But it's very hard when you don't know until you wake up in the morning if you are going to be able to even take a few steps. It's horrible to have to worry about having enough money to even get by. However, even worse for me is not being able to be active. I used to play softball, ride horses, even roller skate - all with my daughter. Now I can't do any of those things. This makes the disease mentally challenging also.

Sue, that's terrible. I just truly do not understand the system!! I'm sorry you didn't have a better outcome. Have you decided to proceed in any way?

You probably won't get the disability based on fibromyalgia alone. Do you have any other health problems? I have fibro, chronic fatigue syndrome, obstructive sleep apnea, degenerative disc disorder, carpel tunnel syndrome, a shoulder replacement and a host of other problems and I was denied twice. I now have an attorney and we are set to go before an ALJ judge November 10th. I don't hold out much hope of winning since the judge I drew only has a 26 per cent approval rate. Even my attorney is disappointed in the judge we drew. But at least if I don't win I don't have to pay the attorney. I have been fighting for disability since May of 2014 so as you can see it takes a long time. I am making myself physically sick with worry over this. I have been having chest pains and feeling sick to my stomach since Sunday. I saw my PCP who recommended I have a stress test done. That is scheduled for October 10th. He must not think it's to serious or he would have gotten me in earlier than that. I hope I don't die before then. He told me if the pain gets really severe to go to the emergency room. That's easy for him to say. I have a $300.00 out of pocket copay to pay. So anyway the day is fast approaching and I will have an answer one way or the other. I can't wait for it to be over so I can put this behind me. Hopefully once I adjust to the fact that I got denied (if I do) I will start to feel better by not having to worry about it which causes me to feel physically ill and the depression that comes with it.

I've heard of some who have been awarded ssdi with only fibromyalgia as their sole medically determinable impairment (MDI). Just saying.... ;-)

What is crucial is that you and your lawyer have the evidence showing you can't do substantial gainful activity (SGA).
