I hope somebody can help me with this ASAP! I have been open and honest with my employer regarding my symptoms and trying to get a diagnosis. I have finally been diagnosed with fibromyalgia. The HR person faxed a job duties list to my doctor and wants him to check off what I can and can't do. As we all know with fibro, it's a day to day thing. I am only asking them that on the days that are bad, I would like to do less physical/mental things. There is availability for this at my job. The doctor did send a note saying what I have, the treatment plan and that I am under his care. He does not feel comfortable with filling out the job duties list since it's fibro. This is getting nasty and I want to be able to tell the HR person that they have all they need to know if that's true. The HR person has hounded me from day one and is hounding me on my day off! Please advise! I also have a call into a lawyer. Thanks everyone!

So are they basically downplaying your fibro? That is so not right! Is he saying that he won't sign it because he feels as though your symptoms are not as severe because it is fibro as opposed to some other illness? I just feel like he's being very arrogant, which is something an HR person should not be by any means! I would take it to corporate and see what someone higher up can do. You don't deserve to have that added stress on top of dealing with fibro symptoms.

Why won't the doctor fill out the job duties checklist just because it is fibro? That doesn't make much sense. You have put yourself in a bad position now because you have admitted that a pre-existing condition bars you from completing your work. That means you can't win a workers' compensation case. This is a great reason why we need mandatory minimum stipends for all humans in terms of food and housing. Work should be for people who want something beyond food to eat and a home to live in. It should be for those who want to raise a family, to go on cruises, to golf, to attend sporting events etc. We must move in this direction.

My doctor says it's because I know what I can and can't do on any given day and he doesn't. I'm a veterinary nurse and it is a very physical job. I wanted to keep everyone in the loop, because I didn't want anyone getting hurt if I couldn't hold a fractious animal. You try to be honest, and it blows up in your face. I'm thinking of just going in Mon and saying I have no restrictions and deal with the pain because this is not worth it. I do have a call into my stepsister who is a lawyer regarding this.

I can understand in a way what the doctor is saying as fibro means many things and everyday is different. If right now your biggest concern is handling the animals by yourself and maybe the heavy lifting involved, maybe you should just ask that someone else be avilable to help when the need arises. By having another person to help that will relieve you of some of the physical and mental strain on your bad days.

As time goes by your symptoms will probably fall into a pattern that any restrictions necessary could be added later. I hope things work out for you and your HR person gives you some space away from all this added stressfulness. :)

It's very much a ""damned if you do, damned if you don't " situation. I can understand the doctors point for not wanting to tick the boxes. With Fibro you may be able to wrestle a bear one day but not be able able to pick up a paper clip the next. How can he possibly do a check list when your ability changes day to day. And I think HR knowing the condition is stupid to ask it of him. All he need do is state your condition and that ability varies.
Is there not some kind of disabled persons charter?

At this point everyone in the situation has been made uncomfortable. You probably regret bringing it up in the first place. I don't see why we aren't offered stipends for food and shelter. It is 2013. Why does everyone have to be a slave in order to survive? Work should be for those who have kids or want kids; for those who want to live luxurious lives and travel etc. That would solve this unemployment problem. I wish you luck.

What does state law say about disabilities on the job? What type of doctor are you seeing?

There was a time when doctors felt quite secure telling people they had to change jobs, stop working a the job they have and setting limitations on what a patient should and should not do.

That ended, of course, as corporations kept pushing for policies favoring them over human beings. Your doctor might be struggling with that along with having to admit that you will not get better and he cannot offer you a cure.

He needs to set his ego aside, but I digress.

I suggest you look through some of the online resources for chronic pain, fibromyalgia, and invisible disabilities, even though your doctor is not willing to say you are disabled.

It seems to me as if HR wants to be sure and not have to pay for workers comp or a lawsuit if you get injured on the job. This way, if the Dr. makes the check marks and you do something to hurt yourself, they wouldn't be liable. Seems like they are trying to cover themselves, IMO. Hoping for the best for you.

I completely agree. Our civilization has advanced enough that providing that basic safety net is not only possible, it is fair and just.

No one should work for years, then find themselves left in the cold because they develop an illness.

If people could stop being frightened by the words "socialism" and "communism" they would understand that this type safety net, and those words, have nothing to do with the atrocities that pop into mind as soon as hope is on the horizon.

I talked to my stepsister who is a lawyer and she thinks it is to protect them and me with the ADA. I'm going to have the doctor fax it back saying no restrictions at this time and hope for the best. At least I know I can ask for accomodation if needed. Thanks for everyone's advice!
