Default Medical Malpractice question regarding pain medication- Help!

Hi everyone,

I have a question regarding a very upsetting incident that occurred this week with my doctor. I was prescribed oxycodone about a year ago for my chronic pain, migraines and Fibro. I was told by my GP and other specialists that this was the best solution at the time, as no other meds had helped with my pain.

I started at a fairly low dose of 3 10 mg pills a day and ended up at 10 pills a day and some days 12 pills. Now over the course of the year I had told my doctor over and over and over that I was concerned about the addiction dependency that came along with this drug. He assured me over and over again that as long as this was being used for pain that I wouldn't develop a problem, and that If my pain was increasing then the dose would too and that was ok.

A month and half ago I went to see the doctor and told him at this time that I was up to 8 pills a day. He said that was okay, and even at one point told me to stop being a "Martyr", that this drug was helping my pain, therefor I should take it and stop worrying what it was doing to my organs ect. He would prescribe me 300-500 pills at a time and was well aware of the increase in my dosages and I was always honest with him.

Three days ago I went in to get a new prescription as I was on my last 10 pills. I also want to mention that I had discussed the fact that I was wanting to eventually come off the drug and did not want narcotics in my system anymore.

The doctor seemed to panic at this most recent appointment and told me that he was going to lose his licence as he had received a letter stating that he was to only prescribe 200 pills at a time. He then proceeded to accuse me of being dishonest, and continued to say he was going to lose his licence as he had been giving me more than he was supposed to. I was shocked to say the least as he had always been my advocate and I always was upfront and honest with my doctor. I am an ethical person that wants to not be in pain and would never jeopardize someone else as a result. He then stated I needed a addiction doctor. I was insulted and so upset at this comment, I have become dependent on this as a result of his direction on how and when to take it. I told him I was perfectly fine coming off the oxycodone, if I was sent to a pain clinic to help with alternative measures. He said he could no longer prescribe me any meds to help ween me off the drug and that I would have to figure it out myself. I was appalled as he had just told me that coming off this drug cold turkey is dangerous and the withdrawal is horrendous. I went back to him the following day and asked for help coming off the drug, he refused and said sorry I am not losing my licence over you.

I proceeded to go to another doctor to tell them my story. They said that what he had done by kicking me out the door out of fear of losing his medical licence was wrong and un ethical. I am so upset and I am facing a scary time coming off these meds alone without help. I have no alternative for after If I successfully come off it. In 8 days I will be out of meds completely and no choice to go cold turkey.

Has anyone experienced this. I am scared and feel so alone and distraught. I want help coming off these without experiencing hell and want to know if anyone else has had a knee jerk reaction from a doctor like this. I am so upset. Please help. Is this Malpractice?

He has been handing this out like candy, and I bet not just you.
Yes I'd say it was malpractice as he is the Dr not you. He give you the pills not you. He upped the does his name is on the script .
Go for it .dr like this need a good kick up the ass. This is not your fault .in no way can you be blamed for his cock up.put in a complaint and tell them what he has done and how u were left hanging with no help . It is a very hard drug to come off from what I've been told .he doesn't seem to care if u get hurt why the hell should u. Again this is not your fault x

It really sounds like the doctor is scapegoating you. I'm not an expert but common sense says malpractice.

I hope the new doctor can help you with the predicament you are now in. My thoughts and prayers are with you.

lyndsey, first i want to say you are not alone in this. i am here for you. i do believe you have insurance.
what i think happened to you happened to me as well. first my insurance called him as said i wasnt on enough morphine so she increased the med.
i also had the insurance call and say im taking over the limit on my gabapentin and my two doctors had a pissing contest.
so one doctor took it and and decreased it. the doctor is worried because of the call from the insurance is all.

i just moved to AZ and im trying to get a pain mgt doctor on the mountain to take over my treatment plan with the morphine.
i must have a GP in AZ give a referral to pain mgt. i saw a GP and he agreed with the morphine and sent me a referral to a pm doc. that process from his office took two weeks. that leaves me with two weeks of morphine.after several days of not getting a call back . i called and they gave me a referal to another pm doctor. i saw that doctor the next day. when i saw him and told him of the diagnosis and about the metal reaction that was happening in his office. he pulled his chair and leaned in inches from my face and said listen to me. your talking crazy. ive been in this business 43 years and your telling me things that i have never heard of! you just crazy! i told him that with the metal thing this long im out of it. so i got my wife on the phone to explain the diagnosis to him. he told her she was crazy too!. then my wife called blue cross blue shield and they called him and told him of the diagnosis too!

he came back in the exam room and told me i dont believe that you have any of the things you say! i have never heard of the things you are talking about. i told him i understand that you have never heard of the metal reaction as im the only one in the world with this and im having a study done. i dont expect you to treat that. what else dont you believe? he said ive never heard of small fiber neuropthay! i dont believe that you have lupus! i dont believe in fibromyaglia. he then said i dont know how to treat made up stuff and threw me out of his office.


get on the phone with insurance. talk to nurse n rehab councilor. you can go to rehab clinic.

let me know what happens.
